POWER OF ATTORNEY TO BE ISSUED IN TURKEY
Our client who will issue a power of attorney can personally go to a notary in Turkey and obtain the necessary and relevant power of attorney by providing the information detailed below. This can be done according to the sample types of powers of attorney and the authority contents on our “Types of Powers of Attorney” page, by visiting a notary near their location.
For powers of attorney related to divorce, alimony, recognition, enforcement, and sales, it is required to have special authorization and to include a photograph. Please remember to bring a passport-sized photograph with you when you go to the notary for these types of powers of attorney. Additionally, these types of powers of attorney, which contain special authority, must be issued in two copies.
In cases where you will issue a power of attorney for your company, if you provide the power of attorney as “in your own capacity and on behalf of your company,” you will have granted power of attorney for both yourself and your company, and you will not need to issue a new power of attorney when necessary.
Contracts and powers of attorney that require processing in the title deed, wills, sales with ownership retention, real estate sales promise, foundation deeds, marriage contracts, adoption and recognition, inheritance partition agreements, and other legal transactions that are prescribed to be formally arranged must be made in a “formal arrangement” manner. The formal arrangement is made in a record by the notary according to the situation and desire of the interested party. Therefore, these transactions (business documents) can only be arranged upon a personal application to the notary in Turkey, along with the individual’s ID card, valid passport, and two newly taken passport-sized photographs.

POWER OF ATTORNEY TO BE ISSUED ABROAD
Notary services in foreign countries are performed by consuls. Clients wishing to obtain a power of attorney abroad must personally apply to the Turkish Consulate in the relevant country and obtain the power of attorney through the consulate, based on the details provided on the “Attorney Information” page.
Powers of attorney issued directly by the competent authority of a foreign country cannot be accepted in Turkey unless they are approved by the Turkish consul or diplomatic officials in that foreign country. Powers of attorney issued directly by the competent authority of a foreign country must be approved by the Turkish Consulate and diplomatic officials in that country. This certification is referred to as the “Apostille Convention.”
